class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">De acuerdo a la definici\u00f3n que entrega nuestro C\u00f3digo Penal, la calumnia es <\/span><span style=\"font-weight: 400;\">la imputaci\u00f3n de un delito determinado pero falso y que pueda actualmente perseguirse de oficio.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">El art. 413 CP se\u00f1ala que la calumnia propagada por escrito y con publicidad (como en redes sociales), ser\u00e1 castigada con la pena de 541 d\u00edas a 3 a\u00f1os y una multa de 11 a 20 UTM, en caso de que la imputaci\u00f3n falsa sea de un crimen, por ejemplo, robo, violaci\u00f3n, homicidio, entre otros.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p>A su vez, indica que respecto de la imputaci\u00f3n de un simple delito, ser\u00e1 sancionado con una pena de 61 a 540 d\u00edas y multa de 6 a 10 UTM (por ejemplo, delito de estafa, hurto, entre otros).<span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-7d2c7168 e-flex calumnia (art. 415 CP)<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-663558cd e-con-full e-flex parallax_section_no a publicar la sentencia en peri\u00f3dicos elegidos por el ofendido (el n\u00famero de publicaciones no debe exceder tres veces).<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-345fb8d e-flex e-con-boxed calumnia puede evitar ser condenado si logra probar la veracidad del hecho criminal que hab\u00eda imputado previamente.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-78aaf10 e-flex e-con-boxed La imputaci\u00f3n de un crimen o simple delito penado o prescrito.<\/span><\/p><p><span style=\"font-weight: 400;\">3. La de un vicio o falta de moralidad cuyas consecuencias puedan perjudicar considerablemente la fama, cr\u00e9dito o intereses del agraviado.<\/span><\/p><p><span style=\"font-weight: 400;\">4. Las injurias que por su naturaleza, ocasi\u00f3n o circunstancias fueren tenidas en el concepto p\u00fablico por afrentosas.<\/span><\/p><p><span style=\"font-weight: 400;\">5. Las que racionalmente merezcan la calificaci\u00f3n de graves atendido el estado, dignidad y circunstancias del ofendido y del ofensor.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-ef68086 e-flex e-con-boxed imputaci\u00f3n de un crimen, la pena ser\u00e1 de 61 a 540 d\u00edas y multa de 6 a 15 UTM; y para la imputaci\u00f3n de un simple delito, la pena 61 a 540 d\u00edas y multa de 6 a 10
